MEMORANDUM – RE: Rent Payment on 4/1/20 – COVID-19 (en español también)

The following memo was emailed on 3/23/2020 to all tenants.  Tenants who didn’t receive the email will be sent this link via text and should read it carefully.  It is being copy/pasted into the Blog so other landlords can view it, use it, and implement policies for properties Sloane Realty Group does not manage.  To all all renters: you may also use this as a guideline to request forgiveness with your own landlord.

RE: April 1, 2020 Rent Payment Options

Rent Payment Forgiveness for April 1, 2020

If you will be affected by the stay-at-home order issued today by Gov. Baker, sickened by COVID-19, or unable to work due to quarantine, or any other issue related to the COVID-19 crisis has created a financial hardship for you, please file a request for rent forgiveness as soon as possible.

Anyone who does not pay rent as usual on April 1, 2020 and fails to file a request will be considered in default.  Your request will be considered on a case-by-case basis.  I will respond to your request with a counter-signed copy of any agreement or arrangement we may come to.  It will be considered a legally binding agreement.

If you are the sole Tenant (with no Guarantor) then you should file one request.

If there is more than one Tenant named on the lease, or one Tenant plus a Guarantor, then each person will need to file a request.  Unlike any other circumstance, we will consider each PERSON on their own merits.  It is possible one person is not working and unable to pay but another person is working and is able to pay a portion of the rent.

You may make one the following requests, which shall be taken into consideration at the sole discretion of each owner:

  • Request for non payment of rent for April 2020
  • Request for reduced payment of rent for April 2020
  • Proposal of a payment plan of rent for April 2020

Please use these guidelines as a reason for your individual request:

  • Non payment of rent for April 2020
  • You have been sickened by COVID-19 or are under a mandatory doctor ordered quarantine and have been unable to work. 
  • You have been unemployed for the better part of the current month with no income whatsoever due to your employer laying you off.
          • Also, you have inadequate savings or no savings to pay any portion of the rent.
  • Reduced payment of rent for April 2020
  • You will be unemployed as of 3/24/2020 due to the stay-at-home order, and will not receive your weekly pay at the end of this week, however you have worked as usual up until the stay-at-home-order was enacted.
        • Also, you anticipate returning to work as usual once the stay-at-home order is lifted and anticipate getting back on track, without disruption in May 2020.
  • In a multiple tenant situation: one or more is working and able to pay the rent, but one or more are unemployed, sick, etc, and unable to pay the rent, so consideration for reduced rent would be fair due to the totality of varying situations.
  • You have some savings but need to pay gas, electric, oil, internet/cable, car payment, or other obligations in order to function, work, or otherwise manage daily finances for required goods and service. 
  • You have been working reduced hours for the better part of the current month but anticipate you will resume working your normal full-time schedule once the crisis has subsided.
  • A payment plan (Please note: this plan will likely be given the most consideration by owners)
      • You are currently working, however extenuating circumstances related to the COVID-19 crisis have caused you to be experiencing a short-term financial hardship.
          • You anticipate you can recover from your financial hardship, however need some additional time to pay your rent for April 1, 2020 in full.
          • You can pay some of your rent now, and the balance in full over a specific period of time.

The following proof will be required in order to consider each request.  Please submit the corresponding documentation requested and/or explanations for your request.

  • Non payment of rent for April 2020
      1. Proof of illness or quarantine order by a medical professional 
      2. Proof of unemployment; letter from your employer laying you off or a furlough order 
        1. This type of request must be accompanied by proof of your current position and/or most recent date you worked, or date you stopped working (providing us with proof you were laid off due to the COVID-19 crisis and not for any other reason) and 
        2. most recent pay stub up until your employment temporarily ended and 
        3. why you have not been able to work
      3. If applicable, proof that you’re ineligible to receive federal unemployment benefits of any kind or applied and were denied.
      4. Proof that you can and will return to work for one of the following reasons, please specify:
          1. You will recover from your illness, 
          2. Your quarantine will end on a certain date, 
          3. Your job will be available as soon as the government lifts restrictions (this may apply to bartenders, waiters, kitchen staff, airline or transportation workers, some self-employed people, etc). 
      5. Bank statements providing proof of your financial situation and inability to pay any portion of the rent.
      6. A statement/explanation that you anticipate your ability to get back on track with rent payment in full on May 1, 2020 without disruption.
  • Reduced payment of rent for April 2020
      1. Proof of temporary reduced income for an unknown period of time (provide a current pay stub and one from a month ago proving reduced hours or pay) 
      2. Proof that your current job is going to be a part of the stay-at-home order and that you will return back to work with your usual salary once the order has been lifted.  This would apply to retail workers, non-essential employees, etc.
        1. Propose a reduced payment you feel that you can make, a reasonable guideline would be 30% of any income you earned until you were ordered not to work, or 30% of your anticipated income for April 2020.
      3. Proof that you are either unable to file for federal unemployment benefits/assistance or do not qualify due to the short-term nature of you impending temporary unemployment.  Proof can be in the form of a personal statement.
  • A re-payment plan
    1. Proof that you are currently still employed and anticipate working throughout the crisis (a pay-stub or a written statement).
    2. A written explanation of your temporary financial hardship and your plan to recover from it.
    3. Proof of temporary reduced income for a short period of time that has passed and ability to make future payments. 
    4. Proof that you have the ability to pay an increased rent amount until you have re-paid your rent for April 2020 in full.
      1. Please propose a reasonable amount you think you can pay, either on a weekly or monthly basis.
      2. Please propose a method to submit your payments, such as automatic payment via your bank to the rent payment account, etc.

Text message is not considered an acceptable format.   Email or writing a letter are considered acceptable formats.

If you feel your situation was not specified within this memo please use your judgement in making a request.  The information provided within this memo should be considered as guidance only. There is no specific reason a request may be granted or denied.  A request should not be considered a final decision.  We will respond to you in writing with a decision either granting or denying your request.

Please provide as much supporting documentation as possible or detailed explanations when submitting your request.

A request will not be considered without supporting documentation. A request will also not be considered for those who are not in need. 

If there are any extenuating circumstances that extend the stay-at-home order beyond the  April 7, 2020 end date then another letter will be sent out informing you of additional options.  Please consider this notice specifically pertaining to rent as due on April 1, 2020.

Cualquier persona que no pague el alquiler como de costumbre el 1 de abril de 2020 y no presente una solicitud será considerado en incumplimiento. Su solicitud será considerada caso por caso. Responderé a su solicitud con una copia firmada de cualquier acuerdo o arreglo al que podamos llegar. Se considerará un acuerdo legalmente vinculante.

Si usted es el único inquilino (sin garante), debe presentar una solicitud.

Si hay más de un inquilino nombrado en el contrato de arrendamiento, o un inquilino más un garante, entonces cada persona deberá presentar una solicitud. A diferencia de cualquier otra circunstancia, consideraremos a cada PERSONA por sus propios méritos. Es posible que una persona no esté trabajando y no pueda pagar, pero otra persona esté trabajando y pueda pagar una parte del alquiler.

Puede realizar una de las siguientes solicitudes, que se tomarán en consideración a la sola discreción de cada propietario:

Falta de pago del alquiler para abril de 2020

  • Prueba de enfermedad u orden de cuarentena por un profesional médico
  • Prueba de desempleo; carta de su empleador despidiéndolo o una orden de baja
  • Este tipo de solicitud debe ir acompañada de la prueba de su puesto actual y / o la fecha más reciente en que trabajó, o la fecha en que dejó de trabajar (proporcionándonos pruebas de que fue despedido debido a la crisis de COVID-19 y no por cualquier otro motivo) y
  • recibo de sueldo más reciente hasta que su empleo finalice temporalmente y
  • porqué no has podido trabajar

  • Prueba de que su trabajo actual será parte de la orden de quedarse en casa y que volverá a trabajar con su salario habitual una vez que se haya levantado la orden. Esto se aplicaría a los trabajadores minoristas, empleados no esenciales, etc.
  • Proponga un pago reducido que considere que puede hacer, una pauta razonable sería el 30% de cualquier ingreso que obtuvo hasta que se le ordenó no trabajar, o el 30% de su ingreso anticipado para abril de 2020.

Un plan de pago
